Introduction

This Privacy Notice explains how Foodex (also “we,” “us,” or “our”), collects, uses, discloses, retains and protects personal information in connection with your access to and use of our software and related services (the “Service”). By using the Service you accept the practices described in this Notice. If you do not agree, do not use the Service.

 

Defined terms

• Account: a unique profile created to access the Service.
• Affiliate: an entity that controls, is controlled by, or is under common control with a party (control meaning ownership of 50% or more of voting interests).
• Application / Service: the software and related online services provided by the Company.

• Country: Hong Kong, China
• Device: any computing device used to access the Service (e.g., computer, phone, tablet).
• Personal Data: any information that identifies or could reasonably identify an individual.
• Service Provider: any third party that processes Personal Data on our behalf.
• Usage Data: information collected automatically about use of the Service.
• You: the individual or entity using the Service.

Information we collect

• Information you provide. When you register, communicate with us, or use certain features, you may supply identifiers and contact information and other data needed to provide the Service.
• Usage Data (automatically collected). This may include your Device IP address, browser type and version, pages visited, timestamps, session duration, unique device identifiers and other diagnostic or technical data. When you use a mobile Device, we may collect device model, operating system, mobile browser type, device identifiers and related diagnostics. We may also receive information your browser sends when you visit the Service.

Exercise and fitness data

We may process step counts, workout metrics and related exercise information (“Exercise Data”) to improve functionality and the user experience. Exercise Data is processed locally on your Device and is not retained on our servers. You can delete Exercise Data at any time using the in-app controls.

How we use Personal Data

We use Personal Data for lawful business objectives, including to:

• Provide, maintain and operate the Service and its features.
• Create and manage your Account.
• Perform contracts for products or services you request.
• Communicate with you about your Account, security, updates and transactional matters.
• Send marketing or promotional messages about goods or services similar to those you have purchased or inquired about, unless you opt out.
• Respond to support requests and manage inquiries.
• Support corporate transactions (merger, sale, reorganization, asset transfer).
• Analyze usage patterns, improve the Service, and measure promotional effectiveness.

Disclosure and sharing

• Service Providers. We may disclose Personal Data to vendors and contractors who perform services on our behalf, under confidentiality obligations.
• Corporate transactions. In connection with a merger, acquisition, financing, or sale of assets, Personal Data may be transferred to a successor entity; we will attempt to notify affected users where required.
• Legal obligations and protection. We may disclose Personal Data to comply with laws, legal process, or valid governmental requests; to protect our rights, property or safety; to investigate misuse or fraud; or to defend against legal claims.

International transfers

Your information may be processed in countries other than your own, including where our offices, affiliates or service providers operate. Such transfers may be to jurisdictions with different data protection laws. By using the Service you consent to the transfer and processing of your data in those locations. We will use reasonable safeguards to protect Personal Data during transfers.

Data retention

We retain Personal Data only for as long as necessary to fulfill the purposes set out in this Notice, to satisfy legal, regulatory or accounting requirements, to resolve disputes, and to enforce our agreements. Usage Data is generally retained for a shorter period for analytics and service improvement unless retention is justified for security or legal reasons.

Your rights and choices

• Access, correction, deletion. You may access, correct or request deletion of Personal Data we hold about you. If you maintain an Account, you may be able to update certain information in account settings. Requests may also be submitted by contacting us (see below). We may retain certain information where required by law or for legitimate business purposes (e.g., fraud prevention, legal claims).
• Marketing opt-out. You may opt out of promotional communications as described in those messages or by contacting us.

Security

We implement administrative, technical and physical measures designed to protect Personal Data against unauthorized access, disclosure, alteration or destruction. While we endeavor to safeguard information, no security measures are infallible and we cannot guarantee absolute security.

Children

The Service is not intended for persons under 13 years of age. We do not knowingly collect Personal Data from children under 13. If you become aware that we have collected such data without parental consent, please contact us and we will take steps to delete it. Where applicable law requires parental consent for minors, we will seek such consent prior to collection.

Third-party links and services

The Service may contain links to third-party websites or services. We are not responsible for their privacy practices or content. Please review the privacy policies of any third-party sites you visit.

Changes to this Notice

We may revise this Notice from time to time. If we make material changes, we will post an updated Notice on the Service and, when appropriate, provide additional notice (for example, via email or in-app notice) prior to the change taking effect. Continued use of the Service after posting constitutes acceptance of the updated Notice.
